Acceptance of these terms and conditions
By ordering a website with Webadoodle, you are confirming acceptance of these terms and conditions.

Website design service
Your website will be designed especially for you for a fixed cost and to format and timetable agreed in advance. The website design service includes design, website structure and navigation, provision of free stock photos if required, basic copy editing if required, and in-built search engine optimisation (SEO). Domain name registration can be provided on request. It does not include hosting, maintenance or updates. If required, these services are available as part of Webadoodle's separate hosting & maintenance packages. It does not include professional copywriting, bespoke animation or illustrations or ongoing SEO, but I have referral partners who can provide these services.
Wix platform
All Webadoodle's websites are designed using the Wix platform therefore all websites will need to be hosted on the Wix platform and are not transferable. This can be arranged by the client independently or by Webadoodle (see below).

Hosting & maintenance packages
In addition to the design service, Webadoodle offers ongoing hosting and maintenance packages for clients who do not wish to handle this themselves. These can include services such as website hosting, domain name registration, connecting to an existing domain name, maintenance and ongoing updates to text, images and design. The exact services included and the monthly fee will be agreed in advance. This will be charged on a monthly basis and paid by standing order. There is no long term commitment. You can cancel at any time after the first three months. If you do not wish to continue, please email contact@webadoodle at least 7 days before the end of the monthly renewal date to cancel your package. If you cancel your package or if monthly payments cease, your website will lapse.

Payment stages and cancellation for website design
Multi-page websites:
A 30% deposit is required on acceptance of contract and before work commences.
I will design your homepage and you will have the opportunity to request changes. Once the homepage is approved you will be invoiced a further 30%.
On receipt, I will complete the design of the remaining pages and send you a link.
When you are happy to approve the website, I'll request the remaining 40% balance before publication.

One page websites:
A 30% deposit is required on acceptance of contract and before work commences. I will design your website and you will have the opportunity to request changes. When you are happy to approve the website, I'll request the remaining balance before publication.
I will be happy to make any minor adjustments for 30 days post publication.
If you decide to terminate the contract during the design process, you will pay for the time I have already spent at a rate of £45/hour.
If you needed my help in future I could do additional pieces of work on an ad hoc basis charged at an hourly rate or at a fixed rate to be agreed between us.
Payment stages and cancellation for logo and branding design
Webadoodle can provide logo design and social media banners for fixed price fees which will be agreed in advance. A 30% deposit is required on acceptance of contract and before work commences. I will provide draft design(s) and you will have the opportunity to request changes. When you are happy to approve the design(s), I'll request the remaining balance before emailing you the final version(s).

Payment stages and cancellation for website reviews
A 30% deposit is required on acceptance of contract and before work commences. I will produce and email you the review along with an invoice for the balance.

Email addresses
Webadoodle also offers email addresses using your domain name e.g. info@mynewwebsite.co.uk. This is charged on a monthly or annual basis and includes 30GB of cloud storage.

Domain names
If your package includes a domain name, Webadoodle will register that on your behalf. If you decide to stop using Webadoodle's service but wish to retain a domain name arranged by us, ownership will be transferred to you. There is a small admin charge of £25 to transfer ownership. Any 3rd party charges (e.g. by your new domain or website hosting company) will be your responsibility.
If you already have a domain name registered elsewhere, you can use this for your new website. You will be responsible for arranging with your existing domain hosting company to point the domain name (DNS servers) to the new website. This is usually fairly straightforward and Webadoodle can usually help you with this.

Price changes
Website design. We will agree a fixed price for your website design. This will not change unless: the website is not completed and paid in full within 6 months of the original agreement due to delays on your part, or you substantially change the scope of the website required e.g. you request additional pages to be added.
Monthly packages. We will agree a fixed monthly fee for your package. This may need to be renegotiated if you substantially change the scope of the package required e.g. add extra services not in the original package. As long as the required package remains the same, the amount charged monthly is guaranteed to remain the same for at least twelve months. After that, Webadoodle reserves the right to review and alter the monthly fee. At least two months notice will be given of any price change.

Intellectual property rights
By supplying any materials including all details, logos, trade names, copy, images, photographs etc. to us, you are guaranteeing that you have all licenses, rights and approvals to submit & use these materials and that you agree to indemnify Webadoodle for the full amount of any claims and reasonable legal fees incurred in connection with such claims brought by any third party for breach of intellectual property rights or privacy.
The design of the website remains the intellectual preoperty of Zena Barrick at Webadoodle until the contract is paid in full. At this time the copyright belongs to the client who has paid for the website.

Cancellation
Webadoodle reserves the right to cancel your contract at any time. In this case, the ownership of the website would be transferred to you. If domain name has been registered for you, it will be transferred to you, on request, for small admin fee of £25.

Promotion
I may use screenshots and descriptions of your website on my promotional materials such as social media and website. This will help promote both our companies. If you would prefer me not to do this, please let me know and I will respect that.

Downtime
Webadoodle is an AS IS service and cannot accept any responsibility whatsoever for problems arising from temporary or permanent unavailability of the service. Webadoodle will make every effort to ensure the continuous running of your website. However, as with all technology, it is possible that there may be failures from time to time which are beyond our control. Where it is shown that the downtime has lasted for a period of 7 days or more, you will be offered a pro rata refund for the time the website was offline. Webadoodle accepts no liability for any loss or damage including without limitation indirect or consequential loss or damage whatsoever arising out of or in connection with any downtime.

Notices
All notices will be sent to the email address provided by you on the order form. You must notify us immediately of any changes to your contact details so that we can get in touch with you regarding your website. Please add the @webadoodle.co.uk domain to your safe senders list to ensure you receive all our emails.
