Webadoodle offers straightforward web design service. I have tried to make these terms and conditions clear and simple.

Acceptance of these terms and conditions
By ordering a website with Webadoodle, you are confirming acceptance of these terms and conditions.

Website design service
Your website will be designed especially for you for a fixed cost and to a format and timetable agreed in advance. The website design service includes design & build, built-in SEO and domain connection. Domain name registration can be provided on request. It does not include hosting, maintenance or updates. If required, these services are available as part of Webadoodle's separate hosting & maintenance packages. It does not include professional copywriting*, provision of images*, bespoke animation or illustrations or ongoing SEO. If these services are required I will refer you to one of my referral partners if possible. 
(*except in the case of the Business Launchpad package)

 

Wix platform
All Webadoodle's websites are designed using the Wix platform therefore all websites will need to be hosted on the Wix platform and are not transferable. The client will require a Wix package. This can be arranged by the client independently or by Webadoodle (see below).

Hosting, maintenance & updates after publication
I will build this website using the Wix platform to give you the option of maintaining it yourself going forward. In this case you will be responsible for paying Wix for hosting your website.

Alternatively, you can pay a monthly retainer and I will cover the hosting, domain registration and all maintenance. I will also do any minor updates/additions up to one hour per month. Minimum term six months. If you do not wish to continue, please email contact@webadoodle at least 7 days before the end of the monthly renewal date to cancel your package. If you cancel your package or if monthly payments cease, your website will lapse.

You can decide which route to take at point of publication.

Payment terms
Payment terms are 21 days. In the case of deposits and stage payments, payment must be made before the next stage starts.

Payment stages and cancellation for website design

A non-refundable 30% deposit is required on acceptance of the contract and before work commences.

Multi-page websites:
I will design your homepage and you will have the opportunity to request changes. Once the homepage is approved you will be invoiced a further 30%.
On receipt, I will complete the design of the remaining pages and send you a link.
When you are happy to approve the website, the remaining 40% balance will be payable before publication.

One page websites:
I will design your website and you will have the opportunity to request changes. When you are happy to approve the website, I'll request the remaining balance before publication.

Website design work post publication

There is a 30 day "safety net" post publication during which time I will be happy to make any minor adjustments to the website.

After this, if you needed my help, I could do additional pieces of work on an ad hoc basis charged at an hourly rate or at a fixed rate to be agreed between us.

 

​Payment stages and cancellation for website design audits

A 30% deposit is required on acceptance of contract and before work commences. I will produce and email you the review along with an invoice for the balance.

Email addresses
Webadoodle also offers email addresses using your domain name e.g. info@mynewwebsite.co.uk. This is charged on a monthly or annual basis and includes 30GB of cloud storage.

Domain names
If your package includes a domain name, I will register it on your behalf and connect it to your new website. If you decide to stop using Webadoodle's service but wish to retain a domain name arranged by me, ownership will be transferred to you. There is a small admin charge of £25 to transfer ownership.  Any 3rd party charges (e.g. by your new domain or website hosting company) will be your responsibility. 

 

If you already have a domain name registered elsewhere, you should be able to use this for your new website. I will assist you to connect the domain to your new website. It is your responsibility to ensure you have the rights to the domain name and the relevant access and login details.

Price changes
Website design.

We will agree a fixed price for your website design. This will not change unless the website is not completed and paid in full within 6 months of the original agreement due to delays on your part, or you substantially change the scope of the website required e.g. you request additional pages to be added.

 

The project must be completed within 6 months of the contract being signed or additional costs may be incurred.
 

Monthly packages.

We will agree a fixed monthly fee for your package. This may need to be renegotiated if you substantially change the scope of the package required e.g. add extra services not in the original package. As long as the required package remains the same, the amount charged monthly is guaranteed to remain the same for at least twelve months. After that, Webadoodle reserves the right to review and alter the monthly fee. At least two months' notice will be given of any price change.

Intellectual property rights

By supplying any materials including all details, domain names, logos, trade names, copy, images, photographs etc., you are guaranteeing that you have all licenses, rights and approvals to use these materials and that you agree to indemnify Webadoodle for the full amount of any claims and legal fees incurred in connection with such claims brought by any third party for breach of intellectual property rights or privacy. 

The design of the website remains the intellectual property of Zena Barrick at Webadoodle until the contract is paid in full. At this time the copyright transfers to the client who has paid for the website.

Cancellation
Webadoodle reserves the right to cancel your contract at any time. In this case, the ownership of the website would be transferred to you within ten working days. You will be refunded for any work not completed. Fees for completed work are not refundable.

 

If you decide to terminate the contract during the design process, you will pay for the time I have already spent at the hourly rate specified in the contract.

Promotion
I may use screenshots and descriptions of your website on my promotional materials such as social media and the website. This will help promote both our companies. If you would prefer me not to do this, please let me know and I will respect that.

​

Downtime
Webadoodle is an AS IS service and cannot accept any responsibility whatsoever for problems arising from temporary or permanent unavailability of the service.

If you are on a monthly hosting contract, I will make every effort to ensure the continuous running of your website. However, as with all technology, it is possible that there may be failures from time to time which are beyond my control. Where it is shown that the downtime has lasted for a period of 7 days or more, you will be offered a pro rata refund for the time the website was offline. Webadoodle accepts no liability for any loss or damage including without limitation indirect or consequential loss or damage whatsoever arising out of or in connection with any downtime.

Notices
All notices will be sent to the email address provided by you. You must notify me immediately of any changes to your contact details so that we can get in touch with you regarding your website. Please add the @webadoodle.co.uk domain to your safe senders list to ensure you receive all our emails.
